GENERAL TERMS AND CONDITIONS
These General Terms and Conditions (as amended from time to time) together with any documents referred to herein is the legally binding contract between the School, the Guardian(You) and the Student/s(all students registered under your online registration account on our portal), which shall continue to apply and remain in full force and effect throughout all Students registration at the School, unless terminated by the School in accordance with this Agreement.
1. DEFINITIONS AND INTERPRETATIONS
Unless the context otherwise states or requires all capitalised words used in this Agreement shall have the following meanings:
“Agreement” means these general terms and conditions.
“Branch” means a branch or hired premisesof the School.
“Fee” means the sums payable to the School by the Guardian may be listed on (https://www.alharamainschools.co.uk/html/curriculum.html) or as informed by Al Haramain Schools.
“Guardian” means a parent and/or a legal guardian of the Students.
“School” means Al Haramain Schools, United Kingdom.
“Studentor Students” means allchild/renregistered withthe School by the Guardian.
“Year” means the academic year as per the Schools’ calendar and programme registered to.
“Portal” means the Schools online portal system containing Student and Guardian/Parent registration accounts.
1.2 Clause, schedule and paragraph headings shall not affect the interpretation of this Agreement.
1.3 A reference to a statute or statutory provision is a reference to it as amended, extended or re-enacted from time to time and includes all subordinate legislation made from time to time under that statute or statutory provision.
1.4 Any obligation on a Party not to do something includes an obligation not to allow that thing to be done.
1.5 Any words following the terms including, include, in particular, for example or any similar expression shall be construed as illustrative and shall not limit the sense of the words, description, definition, phrase or term preceding those terms.
1.6 Whereany clause is exclusive to only one mode of study it will state (online) for online classes and (in Branch) for physical in Branch classes.
2. ATTENDANCE & PUNCTUALITY
2.1 The Student must arrive(if studying physical in Branch) / login (if studying online) on time. For security reasons, the Branch may be locked twenty minutes after the classst art time and will reopen at the class end time.
2.2 The Guardian must inform the School if the Student is running late by logging it on the portal at (portal.alharamainschools.co.uk).
2.3 If the Student islate or absent 3 times or more without valid reason provided, the School shall have the right to terminate this Agreement and no portion of the Feespreviously provided hereunder shall be repayable or refunded to the Guardian. Inno event shall any termination relieve the Guardianof the obligation to pay any and all remaining Fees payableto the School for the full academic year.
2.4 The Guardian understand that lateness and absence can affect the Student’slearning and that the Guardian isrequired to supplement the Student’slearningat the School by putting in a lot of effort and time at home.
2.5 The Guardian must promptly inform the School if they intend, for whatever reason, to remove the Student from the School(no portion of the Fees previously provided hereunder shall be repayable or refunded in accordance with the School’s policy, liability for payment to the School by the Guardian will remain of the outstanding fees for the full academic year).
2.6 The School shall not be responsible for absent Student or for informing the Guardian of the Student’snon-attendance. It is the sole responsibility of the Guardianto ensure that the Studentis attending the classes at the School.
2.7 The Guardian must ensure the Student brings all books and stationery to class. There is a £5-£10 charge for each missing book/diary/bag.
2.8 In the event that classes take place in Branch, the Guardian shall inform the School of the Student’s parental situation, including whether his/her parents live separately, so that security procedures can beputin place accordingly.
2.9 In the event that classes take place in Branch, the Guardian must collect theStudent promptly at end of class time and shall not take the Student out of class before class time is over unless the School is informed in advance.
2.10 In the event that classes take place in Branch, If someone other than the Guardianis to pick up the Student, then he/she must present the Student’s Schoolcard or a picture of it. For the Student’s safety, the Student will not be released to anyone without the proper identification first being shown. The Guardian must provide a note on the online platform if the Student is to be permitted to leave on their own.
3. HEALTH & SAFETY
3.1 The Guardian must state on the registration forms if the Student hasany allergies, learning difficulties/ special needs or medical conditions, or any other condition/ disposition that may affect their or others’ learning or that may require extra attention. Failure to inform the School of any allergy or condition, etc, at the beginning or at the earliest opportunity known, may lead to cancellation of the Student’s registration without refund.In no event shall any cancellation relieve the Guardian of the obligation to pay any and all remaining Fees payable to the School for the full academic year.
3.2 In the event that classes take place in Branch the School is not responsible for the safety of the Student until they enter the Branch premises, which excludes the car park and any area outside the front door of the premises. the Guardian remains responsible for ensuring that the Students travel safely to and from the branch.
3.3 The School is not responsible for administering any medication to the Student when in Branch;who must, if needed, be able to use their own medication.
3.4 When Student is in Branch, the Guardian hereby consentsto such physical contact with the Studentas may facilitate good safeguarding practice to ensure the Student’shealth and welfare and maintain safety and good order, including to deal with a medical or other emergency.
3.5 The Guardian hereby gives consent for the Student to receive first aid orany necessary medical treatment in the event of accident/injury where parental consent is unobtainable. Medical information will be shared with the Student’s teachers and senior staff.
3.6 The Guardian agrees not to bring theStudent to a Branch where they are suffering from flu, a raised temperature, vomiting or diarrhoea, shortness of breath or wheezing orrecent injury, a break out of rash, chicken pox or other contagious illness, or have head lice or nits or green or yellow drainage from the eye(s).
3.7 The School reserves the right to remove a Student from a Branch where he/she develops a condition or illness, etc, that may potentially compromise the safety and/or wellbeing of the Student him/herself or others or the School’s property.
3.8 The Guardian must collect the Student from the Branch, if the School determines the Student to be too ill to continue the class.
3.9 When in Branch, theStudent shall bring their own packed lunches, which should include a bottle of water. The School is unable to guarantee the provision of drinking water. There is a no nuts policy at the School, so Student must not bring nuts in their packed lunch boxes. However, the School cannot guarantee a nut or allergy free environment. Studentmust not share their lunches with others. Students are not permitted to leave the Branch premises to buy lunch or go home for lunch.
3.10 The Student must besuitably toilet trained and able to adequately feed him/herself without assistance. The Schoolreservesthe right to remove the Student and terminate this Agreement if theyare not able to independently feed themselves or use the toilet. Noportion of the Fees previously provided hereunder shall be repayable or refunded to the Guardian. In no event shall any termination relieve the Guardian of the obligation to pay any and all remaining Fees payable to the School for the full academic year.
3.11 The Guardian shall beresponsible for providingfood and water for the Student. Alunch fee of £8shall be payable by the Guardianwherethe Schoolmake provision for the Student’slunch.
3.12 For online classes, the Guardian and the Studentmust follow the online rules in accordance with the setup manual for online classes available on the portal.
4. DRESS CODE/ MODESTY
4.1 The Studentshallwear clothing that is modest, loose and covers the whole body. Female students over sevenshould wear a black headscarf and a long dress (e.g.Abaya/ Jilbab). Female students should preferably wear scarves that require no safety pins. Male students shall wear a white Thoube and white hat.
4.2 Female students must avoid wearing their hair in a high bun and should not wear decorative accessories above their hijab, such as headbands, broaches, etc. No jewellery or makeup, including nail varnish, should be visible.
4.3 Students must avoid wearing garments or accessories which contradict the spirit of modesty within a Branch.
4.4 The School implements a culture of modesty and not free mixing between genders, any attempts of disrespecting the culture may lead to immediate suspension/exclusion.
5. PAYMENTS, FINES & REFUND POLICIES
5.1 The Guardian confirms the ability to pay the Fees in full and shall, following the registration of the Student at the School, pay the full Feesto the School for the full academic year (9/10 months depending on programme registered to). This shall be effective at all times regardless of any change in personal circumstances, removal, termination, suspension, cancellation, exclusion or otherwise.
5.2 In the event that the Guardian is paying the Fees on a monthly plan, the Guardian shall payan amount of 2 months deposit, the 2 months deposit is non-refundable and utilised for the last 2 months of the academic year. In addition to the deposit, the Guardian shall pay, a 1 month’s fee in advance of the start of the course, and consecutive monthly instalments via Direct Debit before or on the 1st of each following month.
5.3 If the Gaudian is paying the Fees on amonthly plan through direct debits, the Guardian hereby provides the School irrevocable permission to setup and charge account details provided by the muntil the committed payment is cleared in full.
5.4 After registration all payment(s) must be made within the stated dates. The Guardian Acknowledges that the School reserves the right to revoke a Student’s registration and terminate this Agreement where Fees have not been paid on time. No portion of the Fees previously provided here under shall be owed or be repayable or refunded to the Guardian. In no event shall any termination relieve the Guardianof the obligation to pay any and all remaining Fees payableto the School for the full academic year.
5.5 In the event that an agreed monthly, instalmentor cheque paymentis not paid on the due payment date, a late payment admin charge of £20 will be payable by the Guardian.
5.6 In the event that classes take place in Branch and the Guardian is late in picking up the Student by more than 15 minutes, a standard late fee of £15 per 15 mins will be payable to the School. Persistent late collection of children may result in termination of this Agreement and no portion of the Fees previously provided hereunder shall be owed or be repayable or refunded to the Guardian. In no event shall any termination relieve the Guardian of the obligation to pay any and all remaining Fees payable to the School for the full academic year.
5.7 For the avoidance of doubt, full Fees must be paid, even if the Student does not attend any classes.
5.8 No refunds are issued on the basis of a child failing to settle in or change in personal circumstances.
5.9 The Guardian shall be fully liable for any damage, loss or injury to persons or property, however caused, by the Student.
5.10 Fees shall not be refundable under any circumstances, including but not limited to the termination of this Agreement for whatever reason. Any requests for cancellations or refunds should be made prior to starting classes, where a refund is offered in exceptionally rare circumstances, this will be subject to a charge of minimum 80% of the agreed feeof the full academic year.
5.11 The School reserves the right to close any Branch where an event beyond its reasonable control or other force majeure event prevents the performance of its obligations under this Agreement or limits its ability to run safely and effectively etc., and will notbe obliged to make up any ‘missed/lost’ hours/days nor provide any refund or exchange. A force majeure event under these terms shall include acts of God, war, storm, flood, fire, act of terrorism, civil unrest, accident, outbreak of disease or pandemic, failure of utility or transportation services, riot, industrial action, forced closure of school premises, compliance with any law or governmental order/rule/regulation/direction. Where a force majeure event arises that prevents or delays the running of School’sclasses, the School shall inform the Guardian about the nature and extent of the circumstances giving rise to the force majeure as soon as possible.
5.12 In the case any removal, suspension, exclusion, termination, cancellationor otherwisehowever takes place, there will be no refund of any fees previously paid and all / any remaining Fees for the full academic year shall bean obligation to be paid in fullby the Guardian to the School.
6. DISCIPLINE PROCEDURE
6.1 The Student must respect all members of staff and other students; the Student shall behave appropriately at all times. Misbehaving students may be subject to the misbehaviour procedure, as set out in our Behaviour Policy.
6.2 The School reserves the right to exclude any student on grounds of misbehaviour or if they pose a risk to others, without prior notification.
6.3 The Guardian will be suitably informed if the Student is involved in serious or persistent misbehaviour, who may be temporarily or permanently excluded, where appropriate. Suspension or permanent exclusion mayresult from physical violence of any kind, however ‘small’, including things like pushing.
6.4 Moving/defacing/ damaging school or branch property may result in automatic suspension or exclusion from the School.
7. COMPLAINTS/ CONCERNS& COMMUNICATIONPROCEDURE
7.1 Any requests, suggestions or complaints, shall be madevia the online platform or by email at [email protected] The School aims to respond within 5 working days.
7.2 The Guardian shall log their complaint on the online platform to register a complaint and not approach teachers during school time, to avoid disruption to students’ learning.
7.3 To find out about the Student’sprogress throughout the year, please view the online platform regularly and attend the report days at the end of terms. The Guardian shall not attempt to engage in discussions with teachers during the class times.
7.4 Communication/instructions from a Guardianor any person with parental responsibility shall be deemed by the School to be received from both parents.
7.5 Although the online portal shall be the School’s main platform for communication, the Guardian accepts to receive as valid form of communications from the School a textmessage and/or email and/or letter updates related to the School or about the Student.
7.6 The Guardian shall stay up to date with the School’s communications and remain informed about the School and the Student’s involvement therein.
7.7 The Guardian shall ensure that the School is given the correct address and registration form details and at least two contact numbers before registering the Student, and shall update the School with any changes.
7.8 The Guardian agrees to promptly respond to phone calls and communications made by the School.
7.9 The Guardian shallnot attempt to obtain staff contact details or ‘hire’ School’s employees for reasons related to private tuition, leading of Tarawih Salah or other., without first obtaining written permission from the School.
8.1 The Guardian warrants that it has full power and authority to enter into and perform its obligations under this Agreement.
8.2 The School shall notbe liable for loss or damage suffered by the Guardian and/or the Student to the extent that any such failure is attributable to the Student and/ the Guardianor a third party that is not within the School’s control. The School will not be liable for loss or damage which were not foreseeable. The School does not accept responsibility for any loss or damage to the Guardian’s and/or the Student’s propertyincluding missing resources or personal belongings, or lost books of bags.
8.3 The School shall not be held responsible for any injury to the Student and/or the Guardian, or for any damage to property, caused by another student, by any person who is not an employee or authorised representative of the Schoolor by any other third party.
8.4 The School’s liability to the Guardian and/or the Studentfor all loss or damage suffered by either the Student and/or the Guardian shall be limited to the total amount of the Fees payable by the Guardian to the School whilst enrolled on the course at the School.
8.5 Nothing in this Agreement shall limit or exclude liability that cannot be excluded by law.
9.1 The Guardian agrees to the possibility that the Student will learn in a mixed age and for below 7 years a possibility of mixed gender group, since students are grouped into classes based on their level/ ability.
9.2 Based on the School’s assessment process, the School reserves the right to place the Student in the level deemed to be the most appropriate.
9.3 The Guardian herebyconsentsto the Schools’ use of the Student’s photograph, and other information relating to their achievements, for promotional purposes and updating onto the Student’s file on thesystem. Such information may be published in the School’s literature, or on the School’swebsiteand other media platforms.
9.4 Individual opinions held by teachers, speakers, visitorsor members of staff do not represent that of the School, and the School do not accept any liability for any breach of law in this respect.
9.5 Disrespectful, abusive and/or threatening behaviour from the Guardian or family members towards any staff or student or professional partner may result in termination of this Agreement and no portion of the Fees previously provided here under shall be owed or be repayable or refunded to the Guardian. In no event shall any termination relieve the Guardianof the obligation to pay any and all remaining Fees payableto the School for the full academic year.
9.6 Rewards, prizes, points and competitions may be provided to students, it is agreed that rewards are provided as extra, optional and good will from the School with no rights given to the Guardian and/or the Student.
9.7 The Guardian hereby agrees to theSchool’s policies, academic calendar and is satisfied with the School’s holiday dates.
9.8 TheSchool reservesthe right to relocateanyof the Branches, under necessary and exceptional circumstances, to any location within a 3 mile radius at any time.
9.9 Following registration where physical classes had been registered or opted for by the Guardian, online provisions maybe provided as an alternative means of study at the discretion of theSchool, depending on the circumstances faced by the School, and no portion of the Fees previously provided hereunder shall be owed or be repayable or refunded to the Guardian. In no event shall this relieve the Guardian of the obligation to pay any and all remaining Fees payable to the School for the full academic year.
9.10 The School reserves the right to make alterations to courses and teachers without prior notice provided such alterations shall not substantially affect the structure of the course.
9.11 The School reserves the right to close any Branch where an event beyond its reasonable control or other force majeure event prevents the performance of its obligations under this Agreement or limits itsabilityto run safely and effectively etc., and will not be obliged to make up any ‘missed/lost’ hours/days nor provide any refund or exchange. A force majeure event under these terms shall include acts of God, war, storm, flood, fire, act of terrorism, civil unrest, accident, outbreak of disease or pandemic, failure of utility or transportation services, riot, industrial action, forced closure of school premises, compliance with any law or governmental order/rule/regulation/direction. Where a force majeure event arises that prevents or delays the running of School’s classes, the School shall inform the Guardian about the nature and extent of the circumstances giving rise to the force majeure as soon as possible.
9.12 The Guardian hereby waives their rightto sue, claim against or harm the good name/reputation of the School or its management.
9.13 The information provided will be held by the School in accordance with the General Data Protection Regulation (GDPR). The Guardian’s and/or the Student’s information is being collected with the Guardianconsentin order to make provision for the Student’slearning. The School will not share any personal information with any third parties. Information about the Guardian and/or the Student will be held for seven years after The Student’s 16th birthday.
9.14 The School reserves the right to amend these terms and conditions at any time without prior notice to take account of new legislation, Government regulations or recommendations or for any other reason, and will make such variations available to the Guardian.
9.15 If any term of this Agreement is held to be invalid, unlawful or unenforceable, such provision shall to that extent be severed from the remaining provisions of this Agreement which shall continue in full force and effect (construed accordingly).
9.16 Failure or neglect by either Party to enforce at any time any of the provisions hereof shall not be construed nor shall be deemed to be a waiver of that Party’s rights hereunder nor in any way affect the validity of the whole or any part of this Agreement nor prejudice that Party’s rights to take subsequent action.
9.17 At all times following this agreement,this contract/agreement along with terms and conditions will remain in force and shall be applied for any future class/course subscriptions of any and all studentsregistered under yourGuardianportal account at the Schoolregardless whether a separate agreement/contract or terms and conditions for each Student has been signed.
9.18 No term of this Agreement shall be enforceable under the Contracts (Rights of Third Parties) Act 1999 by a person who is not party to this Agreement.
9.19 This Agreement is governed by English lawand the parties agree to submit to the exclusive jurisdiction ofthe English courts.
9.20 Registration at Al Haramain Schools means you (as a responsible Parent/ Guardian/ Carer of registering student) have fully read, understood and agreed to all terms, conditions and policies taking full responsibilityof the Student/s
